In 2000
James Long bought a home that required significant work to remodel and repair structural problems. Although he was in the construction industry with many contacts and in-depth knowledge of building practices and costs; he found contractors added money to the total cost every time they didn’t fully understand the scope of work.
To save money
he thoroughly established the scope with drawings and written directions. He hired engineers where there were structural problems and fully defined every aspect of the job.
Once the job
was fully defined he negotiated better prices and a schedule. On day one his plumber didn’t show. After waiting an hour and a half while attempting to contact the plumber by phone he understood the plumber had other more important tasks that day.
So, James with his lawyer’s help
developed a construction contract that each contractor signed. It said that if the contractor didn’t complete on time he’d pay “liquidated damages” to the homeowner. The problem was that if the contractor was held up in his schedule, he wasn’t liable for damages and even if he was liable for damages it would cost $tens of thousands of dollars in legal fees to collect with no guarantee of a win and even if he won that he’d get paid.
Having experienced this issue
